Terms of Service
These Terms of Service ("Terms") govern your access to and use of Nexamara (the "Service"), provided by Paximara Pty Ltd (ACN 698 449 428, ABN 71 698 449 428) ("Paximara", "we", "us"). By creating an account or using the Service, you agree to these Terms.
1. The Service
Nexamara is a family internet safety platform. It lets a parent or guardian connect family devices through a secure tunnel to a Home Node, apply network-level filtering, view device presence and location, and coordinate family settings. Some features require a paid subscription.
2. Eligibility and accounts
You must be at least 18 years old and the parent or legal guardian of any child whose device or profile you add. You are responsible for the accuracy of your account information, for keeping your credentials secure, and for activity that occurs under your account. You confirm you have the authority to add and manage the devices and child profiles in your family.
3. Acceptable use
You agree not to misuse the Service. In particular, you will not:
- use it to monitor or restrict any person without the lawful right to do so;
- attempt to breach, probe, or disrupt the Service or its infrastructure;
- reverse engineer, resell, or sublicense the Service except as permitted by law;
- use it for any unlawful purpose or in breach of a third party's rights.
4. Subscriptions and billing
Nexamara offers a free tier and a paid subscription, Nexamara Family, billed at the price shown at sign-up (currently A$15 per month, subject to change with notice). Paid subscriptions renew automatically each billing period until cancelled. You can cancel at any time, effective at the end of the current period. If a payment fails, we may suspend paid features after a short grace period. Fees are non-refundable except where required by law, including the Australian Consumer Law.
5. Family and child data
You direct how the Service processes data about your family, including children, for the purpose of family safety and coordination. Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.
6. Your content and devices
You retain ownership of your data. You grant us the limited rights needed to operate the Service for you — for example, to route, filter, and display information you have asked us to manage. You are responsible for the devices you enrol and for ensuring household members understand the Service is in use.
7. Availability
We work to keep the Service reliable, but we do not guarantee it will be uninterrupted or error-free. Filtering and safety features reduce risk but cannot block every threat or guarantee a child's safety. The Service is not a substitute for parental supervision or emergency services.
8. Intellectual property
Nexamara, the Nexamara and Paximara names, and the software and content of the Service are owned by Paximara Pty Ltd or its licensors. These Terms do not transfer any of those rights to you.
9. Disclaimers and liability
To the extent permitted by law, the Service is provided "as is" without warranties of any kind. Nothing in these Terms excludes rights or guarantees you have under the Australian Consumer Law that cannot lawfully be excluded. Where our liability can be limited, it is limited to resupplying the Service or the cost of having it resupplied. We are not liable for indirect or consequential loss.
10. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or to protect the Service or other users. On termination, your right to use the Service ends and we will handle your data as set out in the Privacy Policy.
11. Changes
We may update these Terms. If we make material changes, we will provide reasonable notice. Continued use of the Service after changes take effect means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts.
